New Delhi: Congress leader and Leader of Opposition in Lok Sabha Rahul Gandhi has received interim relief from the Supreme Court in the case of alleged disproportionate assets. The Supreme Court on Monday directed to postpone the proceedings going on in Allahabad High Court till further orders. Besides, CBI and ED have also been asked not to file any report under the instructions of the High Court. This case is against Rahul Gandhi, Karnataka resident S. Vignesh is related to Shishir’s complaint.

Which order of the High Court was challenged by Rahul Gandhi?

Rahul Gandhi had approached the Supreme Court against the orders of the Allahabad High Court, which had asked to get the allegations of disproportionate assets leveled against him verified by the CBI and ED. Questions have been raised on this process by Rahul Gandhi. He has also demanded transfer of the case from Allahabad High Court to Delhi High Court. On this demand also, the Supreme Court has issued a notice to the concerned party.

What happened in the Supreme Court today?

A bench of Justice Joymalya Bagchi and Justice V. Mohana along with CJI Surya Kant heard the case. The court issued notice on Rahul Gandhi’s petition and asked to postpone the Allahabad High Court proceedings for the time being. The next hearing of the case in the High Court was to be held on August 20. Now after the order of the Supreme Court, it will not be possible to proceed further on that proceeding.

What will CBI and ED have to do now?

The Supreme Court has stopped CBI and ED from submitting any investigation report before the Allahabad High Court. That is, based on the earlier instructions of the High Court, the agencies will not be able to tell the progress of their investigation there at present. This stay will remain in place until the Supreme Court gives further orders on the matter.

After whose complaint did the matter start?

The matter is related to Karnataka BJP worker S. Vignesh is related to Shishir’s complaint. The complaint accused Rahul Gandhi of having assets disproportionate to his known sources of income. The complainant had demanded an investigation into the matter by central agencies.

In the proceedings related to this complaint, Allahabad High Court had said in May that if the complaint has been received by the agencies, then the allegations made in it should be verified as per law. The court had also asked CBI and ED to inform them about the progress of the investigation.

What happened regarding the investigation in Allahabad High Court?

During the hearing of the case, the High Court had also raised questions on the reply filed by the CBI. The court had admitted that the progress made in the investigation was not clearly reflected in the agency’s affidavit. After this, CBI was asked to clarify the status of the case.

Regarding ED, the High Court had also said that if any such information comes to light during the investigation, on which action is necessary under the law, then the agency can take appropriate steps at its level.

Did Rahul Gandhi get clean chit from the Supreme Court order?

The Supreme Court’s order on Monday is currently limited to stopping the High Court proceedings and stopping the agencies from filing reports. The court has not given any final decision on whether the allegations against Rahul Gandhi are true or false.

Now the Supreme Court will hear Rahul Gandhi’s main petition along with his demand to send the case to Delhi High Court. Therefore, at this time the next important stage of the legal battle is the Supreme Court.
